Terms of Service

Last updated November 4, 2026

These terms govern your use of crossmart.io and the hosted Crossmart service (“Crossmart Cloud”), provided by Crossmart (a Delaware limited liability company) (“Crossmart”, “we”, “us”). By using them you agree to these terms.

Early access

Crossmart is in early development. Early access, beta and design partner programs are provided as they are, may change or stop, and may contain errors. Do not rely on them as your only record of your catalog, inventory or orders.

Open-source software

The Crossmart source code is licensed under theGNU Affero General Public License v3.0. These terms cover the hosted service and this website, not your use of the source code, which is governed by that license. The Crossmart name and logo are trademarks and are not licensed under the AGPL.

Your account and your data

  • You are responsible for your account and for keeping your credentials safe.
  • You keep all rights to your catalog, content and data. You give us permission to process them only to provide the service to you.
  • You are responsible for the listings you publish and for following the rules of each marketplace you sell on.

Data processing

When your stores send Crossmart data about your customers, such as their orders, you are the controller of that data and Crossmart processes it on your behalf. We:

  • process it only to provide the service and as you instruct through it, and never sell it;
  • read and keep only the data the service needs, as our Privacy Policy describes;
  • protect it with encryption in transit and at rest, and limit access to the people who need it to run the service, who are bound by confidentiality;
  • use service providers (subprocessors) such as hosting and email only under contracts that give the data the same protection;
  • help you answer your customers’ requests to access or delete their data;
  • tell you without undue delay if a breach affects your data;
  • delete the data when you close your account or uninstall Crossmart from a store.

AI features

AI agents suggest content and changes. By default you approve each change before it is applied. If you allow some changes to run automatically, you remain responsible for the result. Review AI output before relying on it.

Acceptable use

Do not use Crossmart to break the law or marketplace policies, to list prohibited or counterfeit goods, to send spam, or to interfere with the service or other users.

Fees

Paid plans are billed in advance by subscription. Prices are shown before you subscribe and may change with notice. Marketplace fees are charged by the marketplaces, not by us.

Third-party services

Crossmart connects to marketplaces and AI providers that we do not control. Their availability and terms are their own, and changes on their side may affect Crossmart.

Disclaimers and liability

The service is provided “as is” without warranties of any kind. To the extent the law allows, Crossmart is not liable for indirect or consequential losses, including lost sales or profits, and our total liability is limited to the amount you paid us in the 12 months before the claim.

Ending use

You can stop using Crossmart at any time. We may suspend accounts that break these terms. On closure we handle your data as described in our Privacy Policy.

Governing law

These terms are governed by the laws of the State of Delaware, USA.
